–Comey Case
comey case
is the defendant in an active criminal case where he is charged with making false statements and obstructing a congressional proceeding during a 2020 Senate hearing. His lawyers contend it is a vindictive prosecution ordered by President Trump for political retribution, which the Justice Department denies.James Comey
Case Details
Charges: Comey faces two counts: one for making a false statement and another for obstruction of a congressional proceeding.
Allegation: The indictment, brought by U.S. Attorney Lindsey Halligan (a former Trump lawyer and White House aide), alleges Comey lied when he reaffirmed prior testimony that he had not authorized anyone at the FBI to leak information to the press. The core of the case revolves around communications with his associate, Columbia Law Professor Daniel Richman, who prosecutors allege Comey used as an intermediary to speak to reporters.
Comey’s Plea: Comey has pleaded not guilty to the charges.
Defense Arguments: Comey’s legal team is challenging the case on several fronts:Vindictive Prosecution: They argue the case is politically motivated, pointing to a social media post by President Trump urging the Attorney General to prosecute Comey and others. Improper Appointment: They contend that the prosecutor, Lindsey Halligan, was improperly appointed to her post and therefore lacks the authority to bring the charges. Ambiguous Question: His lawyers maintain the specific question Comey answered was vague and confusing and appeared to be about a different individual, not Richman.
Recent Developments (November 2025)
A federal magistrate judge has raised sharp questions about the Justice Department’s handling of evidence, describing the prosecutors’ conduct as “highly unusual” and suggesting an “indict first, investigate second” approach. The judge ordered prosecutors to:Produce all seized materials from Daniel Richman’s devices and communications to the defense team for review for potential privilege issues.
Provide a full transcript or recording of Halligan’s presentation to the grand jury after an initial submission was deemed incomplete.
A hearing is scheduled for next week to address the arguments regarding the legitimacy of Halligan’s appointment as U.S. attorney.
